Question

Assalamu ‘alaykum wa rahmatullahi wa barakatuhu Mufti Sahab,

A sister asks if a marriage being performed in front of a Muslim witness and a christian witness is valid?

The condition of having 2 sane baligh male Muslim witnesses wouldn’t be satisfied, but I’d like to have this confirmed by you as I’ve read a fatwa stating that the witnessing of two christian when marrying a christian woman is accepted, wa Allahu a’lam.

Jazakallahu khayran,

Wassalam,

Answer

Muhtaram / Muhtaramah

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.

If nikah (marriage) is conducted between a Muslim man and woman, then the presence of two Muslim witnesses is a condition and if nikah is conducted between a Muslim man and a Christian woman, the presence of two Muslim witnesses or two Christian witnesses will be permissible.
